
From the 2023 Election that Wasn’t to the 2024 Celebration of Choice we somehow fell back into the shadows under the influence of Unelected Special Interests in 2025. Nobody wants to tell you that, with the years of delayed maintenance, which are a form of debt, we are looking at an assessment or a significant increase in monthly fees. Were the maintenance delays taken to pay for the disastrous cable TV contract without raising monthly fees at the time it was put in place?
While some will tell you that you can drink whisky from a bottle of wine and they can show you how, we think Special Interests will play us like a SIM and end the Homeowners Association in dissolution and debt as the 2027 Renewal approaches. Who and What will the New Rulers be?
I am recommending to the Community that we challenge the 2025 Election Results based on flaws in procedures that interfered with a proper Election Process. I have asked for a Reschedule of the 2025 Members Meeting and would like to prepare for that with Proxies and Candidates. I do believe I have the basis to petition the state for arbitration should the Board of Directors fail to remedy. That is advisable as the special interests appointed may be a very serious problem. The arbitration process can be found in the Statutes https://www.flsenate.gov/Laws/Statutes/2018/718.1255. And here is the letter required by F.S. 718.1255 (4)(b)2 that describes the election issues.
I have requested additional documents from the HOA to review how this improper procedure was conducted. I made an inquiry about the nominations days before the meeting as well as at it. If anyone else did I would appreciation you letting me know.
I would suggest you attend whatever meeting we can get rescheduled. Otherwise, I can take your Proxy for you and vote it how you ask me to. It is important that you make sure the person you give your proxy to, knows how you want it voted. You can always take your proxy back at the meeting, if you decide to attend.
If you could possibly serve on the Board of Directors please send in your Candidate’s Form. This community of 83 homes has always had 3-5 Board Members as I can tell from available records. The Governing Documents allow for up to 9 Directors. So we should have at least 4 Candidates in addition to the 5 currently elected Directors.
The Postcard shown above is in the Mail to you. Please respond with your opinion. Reschedule? Arbitrate? Wait Until Next Year? Raise the Fees? Do an Assessment? Or some combination of Fee and Assessment? Renew the HOA or just dissolve it?
Or just sit there and soon own nothing and be happy?
