
The Petition filed for the 2025 Meeting that Wasn’t has hit a glitch and is in limbo. The DBPR is currently holding the Petition that was filed on January 7, 2026. They have informed us that there is no 60 day filing limit because that applies to the election and the election was not held. The main issue of the petition is not about the election. It is about the failure to hold the Annual Members Meeting. The election could have otherwise been rescheduled. Note that the petition has the box for meetings checked as well as elections.
DBPR was apologetic about misinforming us that an HOA could file a non-bining arbitration petition and will be allowing us time to upgrade it to a binding arbitration petition that is required for an HOA. So, what does that mean? It is actually a better filing for the petitioner and more of a problem for the HOA, possibly resulting in an assessment to the Homeowners to pay legal fees. As our Board President has expressed some distress over this, we would first seek internal resolutions.
