Election Update 12/3/2025

The Letter of November 24, 2026 was delivered on November 26th with three records requests for election and related documents. Based on the response to the records requests and lack of a rescheduling, and in view of timelines, the following letter was sent to meet the requirements to petition for arbitration from the the State. This is not a pre-suit arbitration, but an option that has been made available to balance the unfair economic advantage of the HOA over Members.

The letter was delivered today along with a fourth records request.

F.S. 718.1255, in part:

SECTION 718.1255. Alternative dispute resolution; voluntary mediation; mandatory nonbinding arbitration; legislative findings.

1) DEFINITIONS.-As used in this section, the term “dispute” means any disagreement between two or more parties that involves:

(a) . . .

(b) The failure of a governing body, when required by this chapter or an association document, to:

1. Properly conduct elections.

2. Give adequate notice of meetings or other actions.

3. Properly conduct meetings.

4. Allow inspection of books and records.
